1.- Obligations of the Users

These terms of use shall apply to the use of the public part of the website by any user.

Users are obliged to make proper use of the website in accordance with the law and this legal disclaimer. The user shall be liable to MOA or third parties for any damages that may be caused as a result of a breach of this obligation.

It is expressly forbidden to use the website for purposes harmful to MOA’s property or interests or that in any other way overload, damage or render useless the networks, servers and other computer equipment (hardware) or computer products and applications (software) of MOA or third parties.


2.- Industrial and Intellectual Property

The website, including its graphic design, as well as the contents thereof, understood as data (including measurements), text, photographs, graphics, images, software and other content, are the intellectual property of MOA or third parties who have licensed it to MOA, without any of the exploitation rights recognized by current legislation on intellectual property being transferred to the users. In particular, users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the contents except to the extent necessary for browsing the website, in cases authorized by law or when expressly authorized by MOA and under the terms and limitations stipulated for such purposes in the corresponding contract signed between MOA and the User.

The distinctive elements (trademarks, trade names, etc.) are owned by MOA without it being understood that access to the web gives users any right over such trademarks, trade names and / or distinctive signs.

 

3.- Access and/or functionalities related to MOA’s training offer

Only persons expressly authorized as users (“User/s”) who have contracted MOA’s services may access and/or make use of the functionalities enabled on the website directly related to training programs provided by MOA. The terms and conditions of the services, as well as the access and use of the aforementioned functionalities shall be governed by that stipulated in the General Conditions in force at any given time and that the user must accept, expressly and unequivocally, when requesting its contracting (by checking the corresponding box enabled for such purposes in the form provided to the user).

 

4.-Exclusion of liability
4.1-Service availability
MOA attempts to keep the website up and running and error-free, but the user agrees to use the website at the user’s sole risk. The website is provided “as is” without warranty of any kind, express or implied, and, except as may be legally required under applicable law, we make no warranties of merchantability or fitness for a particular purpose, nor do we warrant that access to or use of the website will be uninterrupted or error-free. In addition, access to the website requires services and supplies from third parties, including transport through telecommunications networks, the reliability, quality, security, continuity and operation of which MOA does not own or control. MOA shall not be liable for failures or disconnections in telecommunications networks or other services provided by third parties that cause the suspension, cancellation or interruption of access to the website.

The website may include links that allow the user to access other internet pages and portals (hereinafter, “Linked Sites”). In these cases, MOA acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce (“LSSI”) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of the unlawfulness and has not disabled the link with due diligence. In the event that the user considers that there is a Linked Site with illegal or inappropriate content, he/she may notify MOA in accordance with the procedure and the effects established in clause 5 of this Legal Notice, without in any case this communication entails the obligation to remove the corresponding link.

In no case shall the existence of Linked Sites presuppose the existence of agreements with the responsible or owners thereof, nor the recommendation, promotion or identification of MOA with the statements, content or services provided.

 

4.3.- Website Security

The connection to the Web is made through open networks so that MOA does not control the security of data communication or equipment connected to the internet. It is the user’s responsibility to have adequate tools for the prevention, detection and disinfection of harmful computer programs or malicious software. MOA is not liable for damages caused to users’ computer equipment during the connection to the website by acts of third parties or for the lack of security or confidentiality of the information transmitted by equipment and telecommunications networks of third parties or as a result of software or hardware vulnerabilities of the users’ own equipment.
